This Privacy Policy applies to Plexus Australia Pty Ltd (ABN 35 627 543 837) collectively referred to as "we", "us" and "our." This Policy governs our operations and explains how we handle personal information and comply with the requirements of applicable privacy laws ("Privacy Laws"). We respect your individual privacy. By visiting this web site under the domain www.plexusworldwide.com.au or any affiliated ambassador site (collectively referred to as “Site”) or using any of the services offered on the Site, you acknowledge that you accept the practices and policies outlined in this Privacy Policy. This Privacy Policy is effective as of March 2019, and covers the following areas:
- What personal information we collect and how we collect it;
- The purposes for which we use and disclose this information;
- The steps taken when this information is disclosed overseas;
- The security procedures in place to protect the loss, misuse or alteration of information under our control; and
- How you can correct any inaccuracies in the information we hold.
1. Collection of your Personal Information
In this section we explain the types of personal information which we usually collect as well as how we collect this information. We collect information on the Site at two different stages:
- First, we collect anonymous, aggregate information (such as domain name or IP address) from all visitors to the Site. This type of information is never linked to any personally identifiable information and is only used in the aggregate to generate statistical reports about the use of the Site.

- Information we require to deliver, service or fulfil our refund/buy back policies or our legal obligations relating to our products";
- Information you provide to us via customer service, website, application forms, or directly to our team members in relation to our products and income opportunity; and
- Device identification information when you use a computer, mobile phone, smart phone, tablet, or other device to browse or shop on our website. This information may include cookies, your device IMEI number, IP address or MAC address.
Normally we collect information from you directly, unless it is unreasonable or impracticable to do so. Collection of your personal information can occur through the following interactions:
- Via the Site when we ask you to provide personal information or collect it from you, for example, when you register for the use of the Site, subscribe to any services provided through the Site or place a product order;
- During conversations with our team members or Ambassadors;
- When you complete purchase orders, registrations, requests or applications for our products (by phone, in person or electronically);
- When you communicate with us directly (by email, telephone, direct mail or any other means); and
- When you enter our promotions, competitions or special events. We may also collect personal information about you from the following third parties:
- If you are a candidate for employment, we may collect information about you from your nominated referees or business contacts, where you have authorised us to do so.
2. If we are unable to collect your personal information
If you do not provide us with the information we request, we may not be able to fulfil the applicable purpose of collection, such as to supply products to you or to assess your application for employment or to become a Plexus ambassador.
3. Use and Disclosure of your Personal Information
We will only use and disclose your personal information in accordance with this Privacy Policy and Privacy Laws. Our main purposes for collecting, holding, using and disclosing personal information are to:
- Supply products to our customers or Ambassadors;
- Respond to enquiries from existing or prospective customers or Ambassadors seeking information about our products or income opportunity;
- Assess and process refunds, exchanges or replacements;
- Process and assess employment or Ambassador applications;
- Enforce agreements between you and us;
- Undertake research and surveys and analyse statistical information to improve our users' experience;
- Comply with laws and our policies including in relation to health and safety and privacy matters;
Except as otherwise provided in this Privacy Policy, we do not sell, rent, share or otherwise disclose personal information to or with any third party not affiliated with or owned by us, except service providers who may assist us in areas such as data storage. We require our services providers to adhere to strict privacy guidelines and not to use this information for any unauthorised purposes. We will never give or sell your personal information to be used for the purposes of sending you unsolicited commercial offers (such as spam) from any third party.
We will not ourselves use your personal information to send you unsolicited commercial offers without your consent. However, we may need to use your personal information to contact you for purposes other than marketing, as for example regarding the status of the Site, your account or where you are a Plexus Ambassador, other matters related to your role in distributing Plexus products. If you do not wish to receive such communications from us, please inform us by sending an email to privacy@plexusworldwide.com or following the instructions that will be provided in each communication.
In carrying out our business, it may be necessary to share information about you with and between our related bodies corporate and organisations that provide services to us. We would not otherwise routinely disclose personal information to another organisation unless required by law, or if we have a good faith belief that such action is necessary to:
- Provide you with a product, which you have requested;
- Transfer the assets and operations of our business to another party as a going concern;
- Comply with a current judicial proceeding, a court order or legal process served on us;
- Protect and defend our rights and interests; or
- Protect the rights, property and other interests of our users or others.
4. Overseas disclosure of personal information
In the conduct of our business we may transfer personal information outside Australia in accordance with Privacy Laws, to countries whose privacy laws may not provide the same level of protection as Australia's privacy law. For example, we may transfer your personal information to cloud storage and IT service providers that are located offshore in countries such as the United States of America. We take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information and we will comply with all applicable laws relating to cross-border data disclosure.
5. Security of personal information
We take commercially reasonable precautions (including by employing appropriate technical and organisational security measures) to protect your personal information from misuse, loss and unauthorised access, modification or disclosure. All of our users’ information, not just the personal information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job are granted access to personal information. All employees are kept up-to-date on our security and privacy practices. The servers that store your personal information are also housed in a secure environment. However, given the nature of the Internet and the fact that network security measures are not infallible, we cannot guarantee the security of your information. 6. Accessing, Correcting, Updating and Deleting Personal Information

If at any time you wish to change your personal information because it is inaccurate, out of date or incomplete, please contact us via the contact details below and we will amend this record. If you wish to have your personal information deleted, please let us know in the same manner as referred to above and we will take all reasonable steps to delete it unless we need to keep it for legal reasons.
7. Notification of Changes
If we decide to change our Privacy Policy, we will prominently post a notice on the main page and other pages of the Site to alert you of the change. If the Privacy Policy changes materially so that your personal information will be used in a manner different from that stated at the time of collection, we will notify users by email, and where necessary we will seek the prior consent of our users. However, you are responsible for ensuring we have a current working email address for you. If the email address you have given us is incorrect or no longer operable, we have no further obligation to notify you apart from posting a prominent notice on our Site. In addition, if we make any material changes in our privacy practices that affect user information already stored in our database, we will post a prominent notice on the main page of our Site notifying users of the change.
